These Terms of Service ("Terms") govern your purchase and use of digital products from PubsProToolkit ("we," "us," or "our"), a sole proprietorship based in New York State, United States. By placing an order, you agree to these Terms.
- Products. PubsProToolkit sells digital download products, including document templates, prompt toolkits, and related materials (the "Products"). Products are delivered electronically after purchase.
2. License to Use. Upon purchase and payment, you are granted a non-exclusive, non-transferable, perpetual license to use the Products for your own personal and professional purposes. You may incorporate the Products into your own work product. You may not resell, redistribute, share, sublicense, or republish the Products, in whole or in part, whether for free or for compensation. Each purchase covers a single user.
3. Intellectual Property. All Products, including their content, structure, and design, are the intellectual property of PubsProToolkit and are protected by applicable copyright and intellectual property laws. Except for the license granted in Section 2, no other rights are transferred to you.
4. Payment. All prices are listed in the currency shown at checkout. Payment is required at the time of purchase. We reserve the right to change prices at any time.
5. Refunds. All sales are final. Due to the nature of digital products, we do not offer refunds or exchanges once a purchase has been made and the file has been delivered. Please review the product description carefully before purchasing. See our Return and Refund Policy for details.
6. Customer Responsibilities. You are responsible for keeping your downloaded files safe. We are not obligated to provide replacement copies if you lose your files, but we will make reasonable efforts to assist.
7. Disclaimers. The Products are provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Products will meet your specific needs or produce specific results. The Products are provided for informational and productivity purposes and do not constitute professional, medical, legal, or regulatory advice.
8. Limitation of Liability. To the maximum extent permitted by law, PubsProToolkit's total liability arising out of or related to your purchase or use of the Products shall not exceed the amount you paid for the Product in question. We are not liable for any indirect, incidental, consequential, or punitive damages.
9. Governing Law. These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New York.
10. Changes to Terms. We may update these Terms from time to time. The updated version will be posted on our website with a revised effective date. Continued use of the site or Products after changes constitutes acceptance of the new Terms.
